eTrain: When a Borrower Dies

This program is intended especially for California credit unions.

Your California credit union probably has established policies and procedures for disbursing the deposit accounts of a deceased member, but what if the member also had a loan? How does the loan get paid?

Join credit union compliance expert Linda Landis in this discussion of the rules and procedures you should follow when a member/borrower dies. Ms. Landis will discuss what constitutes proof of death, the policies and procedures you should have, the role of your collections department, and the activity that is permissible on a decedent account.

Ms. Landis will cover specifics about:

  • Consumer loans
  • Mortgage loans
  • Credit card loans

After this session, you will:

  • Know when to offset a loan with funds on deposit
  • Understand the reclamation process for federal benefit payments
  • Be familiar with the estate rules under Regulation Z
  • Know what to do about collateral that is in collections or foreclosure
  • Understand the claim process with CUNA Mutual
  • Be aware of when and how to file a creditor’s claim
  • Recognize when to implement loss mitigation to protect your collateral’s value

Meet the presenter, Linda Landis:
Linda Landis is the Compliance Officer for Kinecta Federal Credit Union, a large credit union in Southern California. She implemented and actively manages their compliance program which entails compliance oversight for Kinecta’s Compliance program which encompasses a wide variety of products and services, mortgage and consumer lending and Nix Financial Services.

Prior to Kinecta, Linda worked for the California Credit Union League in their Education and Training Department and Research and Information for almost nine years. She has earned CUNA’s designations of Credit Union Development Educator and Credit Union Compliance Expert in addition to NAFCU’s National Certified Compliance Officer designation. Linda holds her Bachelor of Science in Organizational Development and her Masters of Science in Leadership and Management from the University of LaVerne.
