eTrain: When a Borrower Dies

Collecting consumer debts is always a challenge -- and it becomes more of a challenge after the consumer has passed away! Who can you contact?  Why can't you contact?  What can and can't you say? Who is liable to pay the debt?  If the decedent had assets at the time of death, aren't those assets supposed to be used to pay debts? Who makes that happen? And what if there was collateral for the debt; what happens to that?

During this program, attorney Eric North will answer those questions and also discuss these issues: 

  • How FTC rules issued in 2011 affect credit unions lenders attempting to collect debts owed by deceased borrowers, whether those rules apply to you, and why they matter even if they don't apply.
  • Who you can (and cannot) talk to when collecting decedents' accounts and what you can (and cannot) say.
  • What your rights are when a relative or friend of the decedent has (or is living in) your collateral.
  • The difference between formal and informal estate administration, why it matters, and how to handle each.
  • Why some of a deceased borrower's assets are beyond the reach of creditors.

Meet the Presenter: Eric North is a nationally recognized and respected attorney and legal authority on issues that affect credit unions. He has more than twenty-five years of experience in financial service, including legal representation for credit unions and management of lending and depository institutions. Together with the other attorneys in his firm, Moore Brewer Jones Tyler and North, he devotes most of his legal practice to the representation of credit unions in litigation and compliance matters.
